This Agreement (“Agreement”) is made between experts and Hawkfish AS, operating CSPE.com (“Company”). By accepting this agreement and offering services on CSPE.com, experts agree to the following terms:
1. Independent Contractor Status
1.1 You acknowledge and agree that you are acting as an independent contractor and not as an employee, agent, or representative of CSPE.com or Hawkfish AS.
1.2 You are solely responsible for any taxes, insurance, or legal obligations arising from your compensation through CSPE.com.
2. Scope of Work
2.1 You will provide one-on-one technical support services to clients through CSPE.com’s platform.
2.2 You determine your own availability and services offered, subject to compliance with CSPE.com policies.
3. Conduct and Obligations
3.1 You agree to: (a) Deliver services in a professional, respectful, and timely manner; (b) Maintain strict confidentiality over all client data and interactions; (c) Never use client data for personal or external purposes; (d) Disclose any potential conflict of interest; (e) Avoid making promises or guarantees that cannot be upheld.
3.2 Any violation may result in suspension or termination from the platform and potential legal liability.
4. Compensation and Payment
4.1 You will connect your own Stripe account to receive payments directly from clients.
4.2 You will receive 100% of the session fee (minus any Stripe or processing fees) directly to your Stripe account.
4.3 You are solely responsible for managing refunds, disputes, taxes, invoicing, and compliance with local financial regulations.
4.4 CSPE.com does not handle or interfere with the payment processing between you and the client.
5. No Guarantee of Engagement
5.1 CSPE.com does not guarantee you will receive any minimum number of bookings or income.
5.2 The platform retains the right to remove your profile or suspend access without notice if standards are not met.
6. Liability and Indemnification
6.1 You understand that you are fully liable for the advice or services you provide.
6.2 You agree to indemnify and hold harmless Hawkfish AS and CSPE.com from any claims, disputes, damages, or losses arising from your conduct, negligence, or performance.
7. Dispute Resolution
7.1 Any dispute arising out of this Agreement shall be governed by Norwegian law and resolved in the courts of Norway.
8. Term and Termination
8.1 This Agreement remains in effect as long as you offer services on CSPE.com or until terminated by either party.
8.2 CSPE.com may terminate this Agreement with immediate effect for breach of terms, misconduct, or reputational risk.
9. Acceptance
By clicking “I Agree” or offering your services through CSPE.com, you confirm you have read, understood, and accepted this Expert Agreement in full.
